TikTok Shop Việt Nam quy định các loại sản phẩm không được phép bán trên nền tảng, bao gồm hai nhóm: (1) Sản phẩm bị cấm (Sản phẩm cấm) theo quy định pháp luật Việt Nam, và (2) Sản phẩm không được hỗ trợ (Unsupported) - tức là dù người bán có đủ điều kiện pháp lý để bán tại Việt Nam nhưng TikTok Shop không hỗ trợ giao dịch. Nội dung này áp dụng cho tất cả người bán trên TikTok Shop Việt Nam trong quá trình đăng sản phẩm.

SẢN PHẨM BỊ CẤM (Sản phẩm cấm):

  1. Sản phẩm bất hợp pháp: Hàng giả, hàng Vi phạm quyền Sở hữu trí tuệ, sản phẩm không tuân thủ tiêu chuẩn pháp lý, chứng nhận, tiêu chuẩn kỹ thuật.

  2. Sản phẩm và dịch vụ người lớn: Đồ chơi tình dục, trò chơi phim ảnh người lớn (X, XXX, R21), trang phục gợi cảm, đồ khổ dâm, thuốc tăng cường tình dục, nội dung khiêu dâm liên quan đến trẻ em hoặc hành vi phi tự nguyện, dịch vụ hẹn hò/escort.

  3. Rượu, thuốc lá và thuốc lá điện tử: Thuốc lá điện tử (vape, pod), tất cả sản phẩm chứa thuốc lá (thuốc lá điếu, xì gà, thuốc lá nhai), máy cuốn thuốc, phụ kiện hút thuốc (điếu cày, điếu bát, tẩu), shisha/hookah, miếng dán nicotine, kẹo cao su nicotine, sản phẩm có logo Thương hiệu thuốc lá, sản phẩm quảng bá hút thuốc, hình ảnh trẻ em hút thuốc.

  4. Động vật và sản phẩm liên quan: Động vật sống, động vật hoang dã/nguy cấp (tê giác, đười ươi, voi) và các bộ phận (ngà, sừng, da, lông, xương, răng), dao “slasher” đá gà, sản phẩm/media quảng bá ngược đãi động vật.

  5. Tiền tệ, thẻ quà tặng và sản phẩm tài chính: Tiền xu/tiền giấy có giá trị lưu thông pháp định (dù là đồ sưu tầm), tiền giả, tem giả, thiết bị tạo tiền giả, đồ thủ công nghệ thuật và cổ vật được bảo vệ, vàng/bạc không đóng dấu tuân thủ pháp luật.

  6. Sản phẩm phân biệt đối xử/xúc phạm: Sách, âm thanh, video tài liệu kích động thù ghét, phân biệt chủng tộc/tôn giáo, ca ngợi tội phạm bạo lực/tình dục, kỳ thị dựa trên đặc điểm cá nhân (chủng tộc, dân tộc, màu da, tôn giáo, tuổi tác, giới tính, xu hướng tính dục, bản dạng giới, tình trạng gia đình, khuyết tật).

  7. Vật phẩm chính phủ và quân sự: Đồng phục cảnh sát/quân đội, huy hiệu, biển hiệu, biển số xe, giấy tờ tùy thân, bằng cấp chứng chỉ, thiết bị báo động khẩn cấp, đèn chớp, gậy điện, còng tay, còi cảnh sát, vật phẩm của Hội Chữ thập đỏ/Hội Trăng lưỡi liềm/Hội Pha lê đỏ (trừ đồ lưu niệm chính thức), vật phẩm có biểu tượng này.

  8. Vũ khí, đạn dược và vũ khí: Súng quân dụng, súng thể thao/săn bắn, súng bắn BB, súng sơn, súng hơi, súng khí nén, súng bắn nước mắt, súng khởi động, bộ phận súng (đạn, hộp tiếp đạn, nòng súng, bộ chuyển đổi, kim hỏa), phụ kiện ngoài (giảm thanh, báng súng, bu-lông), dao switchblade, dao bướm, bất kỳ loại dao có lưỡi nào, vũ khí quân sự, lựu đạn, súng điện, roi, dùi cui, bình xịt hơi cay, hơi ngạt, roi da, chùy, phi tiêu, nỏ, súng cao su, ná, sách hướng dẫn chế tạo vũ khí.

  9. Vật phẩm nguy hiểm: Chất nổ, thuốc nổ, pháo hoa, pháo nổ, tia lửa, tên lửa, chất độc, chất gây ung thư, hàng bị thu hồi, đồ chơi/game nguy hiểm cho trẻ em (về thể chất hoặc tinh thần), phụ gia thực phẩm, thực phẩm chức năng, thực phẩm biến đổi gen chưa được phép.

  10. Sản phẩm từ cây gai dầu: Dầu hạt gai dầu, kem dưỡng thể gai dầu, thức ăn chim gai dầu, chip gai dầu.

  11. Bộ phận và thi thể người: Bộ phận cơ thể, chất thải/nguy cơ sinh học, thi thể, tinh trùng, trứng, phôi, dịch vụ môi giới mang thai hộ.

  12. Ma túy và dụng cụ ma túy: Ma túy, steroid, hóa chất nguyên liệu sản xuất ma túy (cần sa, thuốc phiện, hạt thuốc phiện), dụng cụ hút/bong, ống thủy tinh, máy hóa hơi.

  13. Thuốc và thiết bị y tế: Thuốc kê đơn, thuốc không có giấy phép, sản phẩm CBD/cannabinoid/cây gai dầu có tuyên bố y tế, steroid tăng cơ, Comfrey, DHEA, Ephedra, hormone tăng trưởng, thuốc tăng cường tình dục.

  14. Sản phẩm vi phạm pháp luật/hành vi gian lận: Giấy tờ giả mạo, thiết bị do thám điện tử, thiết bị giải mã truyền hình cáp, radar scanner, thiết bị nghe trộm, điện thoại nghe lén, thiết bị can thiệp sóng radio/GPS, bộ lặp/khuếch đại sóng điện thoại, thiết bị sửa đồng hồ tua, thiết bị bẻ khóa, vé số, máy đánh bạc.

  15. Sản phẩm có bản đồ: Thiếu quần đảo Hoàng Sa và Trường Sa, hoặc có quần đảo Xisha/Nansha, hoặc có “đường lưỡi bò” (nine-dash line) - bao gồm địa cầu, thiết bị GPS, áo phông, cốc, bao hộ chiếu.

  16. An toàn và quyền riêng tư: Phần mềm/thiết bị đánh cắp thông tin cá nhân, website lừa đảo, thông tin cá nhân (số điện thoại, email), CMND/hộ chiếu, phần mềm đánh cắp dữ liệu.

  17. Thực phẩm không an toàn: Thực phẩm có tuyên bố y tế, thực phẩm chứa chất cấm vượt ngưỡng, thực phẩm bôi trơn/ghi nhãn sai, sản phẩm sữa không tiệt trùng, nấm rừng.

  18. Hàng tiêu dùng không nhãn mác/đóng gói lại: Sản phẩm không có nhãn mác nhận diện, thuốc, thực phẩm, mỹ phẩm đã bị người bán đóng gói lại.

  19. Sản phẩm khác: Cổ vật, khoáng sản xung đột, kim cương xung đột, hàng cấm vận, hàng hết hạn/sai nhãn, hàng ăn cắp, hàng bị thu hồi, nhà ở trợ cấp chính phủ, hôn nhân bất hợp pháp, chủ đề siêu nhiên, bói toán/phù thủy, rửa tiền, lừa đảo đa cấp.

SẢN PHẨM KHÔNG ĐƯỢC HỖ TRỢ (UNSUPPORTED):

  1. Sản phẩm người lớn: Vật phẩm sức khỏe tình dục (bao cao su, chất bôi trơn)
  2. Rượu, thuốc lá: Rượu
  3. Thương hiệu phản hồi tiêu cực cao: Astarry, XFX, FG, INDONG, ILezu, Cuvkm
  4. Tiền tệ/tài chính: Thẻ quà tặng, phiếu giảm giá, chứng chỉ giá trị điện tử, Bitcoin, Litecoin, kim loại quý, lệnh chuyển tiền, séc du lịch
  5. Sản phẩm truyền thông: Sách ngoài danh sách cho phép, kịch bản, bản thảo, tạp chí, CD/DVD, trò chơi điện tử
  6. Thuốc và thiết bị y tế: Thuốc không kê đơn (OTC), thiết bị y tế (máy thở, thiết bị y tế gia đình), dụng cụ sức khỏe tình dục
  7. Sản phẩm chính trị: Liên quan đến chính trị gia, đảng phái, chiến dịch tranh cử, bầu cử
  8. Bất động sản: Nhà ở, tòa nhà, khách sạn
  9. Dịch vụ: Mọi loại dịch vụ (tuyển dụng, du lịch, xây dựng, chăm sóc cỏ, điện, nước, ô tô, tái chế, hướng dẫn thể hình, tài chính, thú y), vé show
  10. Cổ phiếu/chứng khoán/bưu phí
  11. Sản phẩm ảo: Thẻ thành viên, bảo hành, đăng ký, tải kỹ thuật số, thẻ nạp tiền, vật phẩm/vũ khí trong game, tiền tệ game, tài khoản game, hỗ trợ game
  12. Sản phẩm giảm cân: Thuốc giảm cân, đồ uống giảm cân, tiền chất tăng cơ, prohormone. NOTE: Sản phẩm có tuyên bố “tăng cân” vẫn được bán nếu thuộc danh mục Sữa công thức tăng trưởng, Sữa công thức trẻ em, Vitamin & Thực phẩm bổ sung cho bé. TikTok Shop có quyền yêu cầu giấy tờ pháp lý về phân loại danh mục.
  13. Sản phẩm khác: Sản phẩm lỗi, ắc quy/accumulator (pin axit chì, pin ô tô), bộ xăm hình vĩnh viễn, thuốc trừ sâu/thuốc diệt cỏ/thuốc diệt nấm, dụng cụ săn bắn, khí gas dễ cháy (bình chữa cháy, gas butane, bật lửa, gas hộp quẹt, gas LPG), sản phẩm cần hợp đồng pháp lý phức tạp (nhà ở, đất đai, nhượng quyền thương mại), Quảng cáo/dịch vụ thay vì sản phẩm vật lý.

QUY ĐỊNH VỀ DAO DÙNG TRONG GIA ĐÌNH: Dao nhà bếp, dao bàn, dao cắt thịt, kéo, cưa được loại trừ khỏi danh mục cấm, nhưng phải có nhãn mác và thương hiệu đầy đủ hiển thị trực tiếp trên sản phẩm để tuân thủ quy định và tránh rủi ro.

HẬU QUẢ VI PHẠM: TikTok Shop có quyền xóa sản phẩm nếu xác định là bị cấm, tiềm ẩn bất hợp pháp hoặc không phù hợp. Người bán vi phạm sẽ bị áp dụng biện pháp thực thi, vi phạm lặp lại sẽ bị phạt nặng hơn. Có thể kháng cáo qua Trung tâm Người bán nếu cho rằng bị xử lý nhầm.

Hành động

Người bán cần kiểm tra kỹ danh mục sản phẩm của mình trước khi đăng bán trên TikTok Shop:

  1. Rà soát toàn bộ sản phẩm: Đối chiếu với danh sách cấm và không hỗ trợ chi tiết ở trên, đặc biệt chú ý các sản phẩm dễ nhầm lẫn như dao nhà bếp (phải có nhãn mác đầy đủ), sản phẩm có Thương hiệu bị cấm (Astarry, XFX, FG, INDONG, ILezu, Cuvkm).

  2. Kiểm tra bản đồ/địa lý: Đảm bảo sản phẩm có bản đồ phải hiển thị đầy đủ quần đảo Hoàng Sa và Trường Sa, không có “đường lưỡi bò”, không ghi quần đảo Xisha/Nansha.

  3. Đối với dao dùng trong gia đình: Chỉ đăng bán dao có nhãn mác và thương hiệu đầy đủ hiển thị trực tiếp trên sản phẩm.

  4. Sản phẩm tăng cân: Nếu thuộc danh mục Sữa công thức tăng trưởng/Sữa công thức trẻ em/Vitamin & Thực phẩm bổ sung cho bé, cần chuẩn bị sẵn giấy tờ pháp lý về phân loại danh mục để cung cấp khi TikTok Shop yêu cầu.

  5. Kháng cáo: Nếu bị xử lý Vi phạm nhầm, người bán có thể kháng cáo qua Trung tâm Người bán (Seller Center), tham khảo hướng dẫn kháng cáo trong bài viết Seller Appeal Guidelines.

  6. Thường xuyên cập nhật: Theo dõi các bài viết TikTok Shop Restricted and Unsupported Products Guidelines và TikTok Shop Sản phẩm cấm Products Guidelines để cập nhật thay đổi.

Điều kiện áp dụng

Áp dụng cho tất cả người bán trên TikTok Shop Việt Nam. TikTok Shop có quyền tự quyết định sản phẩm có phù hợp hay không ngoài danh sách nêu trên.
