TikTok Shop có quy trình kháng cáo riêng biệt cho người bán và Creator khi nhận được cảnh báo vi phạm IPR. Đối với người bán: đăng nhập Seller Center, vào tab “Shop Health” → “Vi phạm Records”, nhấn “Appeal” để nộp kháng cáo, theo dõi qua “Appeal Details”. Người bán được phép nộp tối đa 2 lần kháng cáo cho mỗi vi phạm: lần đầu trong vòng 30 ngày kể từ ngày nhận thông báo vi phạm, lần hai trong vòng 15 ngày kể từ khi bị từ chối lần đầu. Đối với nhà sáng tạo: vào trang Account Standing → “Violation Details” → “Appeal”, chỉ được nộp 1 lần kháng cáo trong vòng 30 ngày.

Có 9 loại vi phạm IPR với yêu cầu tài liệu kháng cáo khác nhau:

  1. Trademark Hàng giả (hàng giả mạo nhãn hiệu): Nộp 1 trong 3 loại - Thư ủy quyền từ chủ sở hữu nhãn hiệu hoặc nhà phân phối cấp 1 (bao gồm: tên bên ủy quyền, tên bên được ủy quyền, quyền được ủy quyền, quốc gia, thời hạn ủy quyền, con dấu nếu là tổ chức, chữ ký); hoặc Proof of Purchase (hóa đơn/biên lai) từ Thương hiệu chính hãng hoặc nhà bán buôn/bán lẻ quốc tế có nguồn gốc hợp pháp trong 12 tháng gần nhất (bao gồm ngày mua, thông tin người bán/người mua, thông tin sản phẩm, giá); hoặc Giấy chứng nhận nhãn hiệu từ chính phủ/cơ quan Sở hữu trí tuệ quốc gia/EUIPO/WIPO.

  2. Trademark Wrong Association (nhãn hiệu gắn sai sản phẩm): Thư ủy quyền hoặc Giấy chứng nhận nhãn hiệu.

  3. Trademark Over Use (sử dụng quá mức nhãn hiệu): Thư ủy quyền.

  4. Copyright Piracy (vi phạm bản quyền - hàng nhái): Thư ủy quyền từ chủ bản quyền hoặc Proof of Purchase.

  5. Copyright Unlawful Access (truy cập bản quyền trái phép): Thư ủy quyền.

  6. Copyright Unlawful Reproduction (sao chép bản quyền trái phép): Thư ủy quyền, Proof of Purchase, hoặc Proof of Prior Sales/Prior Use (ngày sử dụng/bán trước, sản phẩm/tác phẩm).

  7. Copyright Content Infringement (vi phạm bản quyền nội dung listing): Thư ủy quyền, Proof of Prior Sales/Prior Use, hoặc Illustration of Differences (hình ảnh so sánh rõ ràng giữa nội dung bị cáo buộc và sản phẩm đăng bán, chỉ ra điểm khác biệt).

  8. Design Infringement (vi phạm thiết kế đăng ký): Thư ủy quyền từ chủ thiết kế đăng ký hoặc nhà phân phối cấp 1, hoặc Illustration of Differences (hình ảnh 6 mặt sản phẩm: trước, sau, trên, dưới, trái, phải và hình chứng nhận IPR), cùng tài liệu bổ sung khác.

  9. Patent Infringement (vi phạm bằng sáng chế): Thư ủy quyền từ chủ bằng sáng chế hoặc nhà phân phối cấp 1, hoặc Illustration of Differences (giải thích lý do sản phẩm không vi phạm, so sánh đặc điểm/chức năng với yêu cầu bảo hộ của bằng sáng chế bị cáo buộc), cùng tài liệu bổ sung.

Kết quả kháng cáo thành công: TikTok Shop gỡ bỏ hình phạt và khôi phục quyền lợi. Không thành công: giữ nguyên hình phạt. Các lý do từ chối phổ biến: thiếu tài liệu, từ chối ban đầu đúng, tài liệu không rõ ràng, tài liệu không hợp lệ/không đủ chứng minh, tài liệu không liên quan đến loại vi phạm.

Hành động

Đối với người bán cần kháng cáo vi phạm IPR: (1) Đăng nhập TikTok Shop Seller Center; (2) Vào tab “Shop Health” → “Vi phạm Records”; (3) Nhấn “Appeal” để nộp kháng cáo; (4) Theo dõi trạng thái qua “Appeal Details”. Lưu ý: chỉ được nộp tối đa 2 lần, lần 1 trong 30 ngày từ ngày nhận thông báo, lần 2 trong 15 ngày từ khi bị từ chối lần 1.

Đối với Creator: (1) Đăng nhập trang Account Standing; (2) Vào “Account Standing” → “Violation Details”; (3) Nhấn “Appeal”; (4) Theo dõi qua “Appeal Details”. Chỉ được nộp 1 lần trong 30 ngày.

Khi nộp kháng cáo, phải chuẩn bị tài liệu phù hợp với loại vi phạm cụ thể:

  • Xác định chính xác loại vi phạm: Trademark Hàng giả, Trademark Wrong Association, Trademark Over Use, Copyright Piracy, Copyright Unlawful Access, Copyright Unlawful Reproduction, Copyright Content Infringement, Design Infringement, hay Patent Infringement.
  • Chuẩn bị đầy đủ thông tin trong tài liệu theo đúng yêu cầu (tên các bên, quyền được ủy quyền, quốc gia, thời hạn, con dấu/chữ ký).
  • Đảm bảo tài liệu rõ ràng, độ phân giải cao, không mờ nhòe.
  • Proof of Purchase phải từ nguồn hợp pháp trong 12 tháng gần nhất.
  • Illustration of Differences cần có hình ảnh rõ ràng so sánh sản phẩm với nội dung/nhãn hiệu/thiết kế/bằng sáng chế bị cáo buộc.

Kết quả

Nếu kháng cáo thành công: TikTok Shop gỡ bỏ hình phạt và khôi phục các quyền lợi đã bị thu hồi. Nếu kháng cáo không thành công: giữ nguyên hình phạt và việc thu hồi quyền lợi.

Điều kiện áp dụng

Áp dụng cho cả người bán (seller) và Creator (creator) trên TikTok Shop, nhưng quy trình và số lần kháng cáo khác nhau. Tài liệu kháng cáo phải phù hợp với từng loại Vi phạm IPR cụ thể. The protection of others’ intellectual property rights is a critical factor in keeping our platform secure. As a result, we take action against sellers or creators who breach our TikTok Shop Intellectual Property Policy and related guidelines.If you receive a notice or warning of infringement and believe the rights owner or TikTok Shop made an error, you may appeal or dispute the claim by raising a ticket/appeal in the Seller Center.The Appeal ProcessIt is important to note that the appeal process and timeline differ depending on if you are a seller or creator.For SellersPlease login to your TikTok Shop Seller CenterClick on the “Shop Health” tab and navigate to the “Violation Records” tab Click on the “Appeal” button to file an appeal Once done, you can click on “Appeal Details” to monitor the status of your appealFor each violation, sellers can file up to two appeals.The first appeal must be filed within thirty (30) calendar days from the date the violation notification was issued.The second appeal must be filed within fifteen (15) calendar days after the rejection of the first appeal.For CreatorsPlease login to your TikTok Shop Account Standing page. Trademark Counterfeit This violation type occurs when the listed product is alleged to infringe on another’s trademark rights as it involves the sale or promotion of counterfeit products. To appeal a counterfeit product violation, you need to submit one of the document types listed here. Letter of Authorisation from the Trademark Owner or Level 1 Distributor. It should include the following information:Name of authorising partyName of authorised partyAuthorised rights (rights to use trademark for the complained products / rights to sell or promote the complained products) Authorised countryAuthorisation periodStamp of the authorising party (if the IPR Owner is a corporate entity)Signature of the IPR Owner (or representative if the IPR Owner is a corporate entity)Proof of Purchase (either a receipt or invoice) from the Brand Principal or Internationally recognised wholesale/Retailer with legitimate sources issued within the last 12 months.
